• Request reasonable supporting documents when needed for a transaction review.
• Escalate unusual, incomplete or higher-risk circumstances for additional review.
• Decline, suspend or condition a transaction when required by law, policy or reasonable compliance concerns.

No compliance programme can replace accurate information from customers, distributors, freight providers, customs professionals and competent authorities.

This page applies to general inquiries, quotations, samples, products, documentation and potential commercial relationships discussed through the Yubeen website.

It does not replace:

• A product-specific classification review.
• A government licence, permit, ruling or authorisation.
• Local legal advice in the exporting, transit or destination country.
• The compliance provisions in a quotation, invoice, purchase order, distribution agreement or sales contract.

Classification can depend on the exact product, components, technical characteristics, software, accessories, destination, applicable legal regime and transaction date.

Certain goods, technologies, software, documentation or services may be subject to export, re-export, transfer, transit, brokering or technical-assistance controls.

The relevant requirements may depend on:

A product being commercially available or described as civilian does not automatically mean that every export, import or end use is unrestricted.

A destination may be subject to restrictions imposed by one or more relevant authorities. Restrictions can apply to a country, territory, region, entity, sector, product category or specific type of transaction.

We may decline or pause an inquiry where:

• The destination is prohibited or subject to restrictions that cannot be satisfied.
• The transaction route creates unresolved sanctions, transit or diversion concerns.
• Required destination or consignee information is incomplete or inconsistent.
• A freight, payment or intermediary arrangement creates unresolved risk.

Restrictions change over time. A previous sale or quotation does not confirm that a later transaction is permitted.

Products and technical information must not be used, transferred, adapted or diverted for a prohibited purpose.

Depending on applicable law and the product, prohibited or restricted uses may include:

• Activities prohibited by applicable sanctions or export-control laws.
• Unauthorised military, weapons, proliferation or weapons-of-mass-destruction related uses.
• Unlawful surveillance, repression, violence or human-rights abuse.
• Circumvention of local ownership, possession, registration or licensing requirements.
• Resale or diversion to an undisclosed user, destination or intermediary.

A transaction review may include the purchaser, importer, consignee, distributor, dealer, freight forwarder, payment party, beneficial owner and ultimate end user.

We may request:

• Legal name, registration and business information.
• Ownership, control or beneficial-ownership information where reasonably necessary.
• The ultimate delivery location and end user.
• The intended use, resale channel and customer type.
• An end-user, end-use, no-diversion or similar declaration.

Information supplied through another party does not remove the responsibility to identify the true destination and ultimate user.

Customers, importers, distributors and other transaction parties are responsible for complying with the laws and approvals applicable to their activities.

• Provide accurate and complete information.
• Confirm local import, possession, use, resale and registration requirements.
• Obtain required permits, approvals and licences within their responsibility.
• Avoid unauthorised diversion, transfer or resale.
• Inform Yubeen promptly if the destination, purchaser, consignee, end user or intended use changes.
• Flow appropriate compliance obligations to downstream dealers and customers.

The extent of review can differ according to the product, destination, customer, quantity, intended use and risk indicators.

This sequence is illustrative. Steps may be repeated, combined, omitted or expanded depending on the transaction and applicable requirements.

A transaction may require an export licence, import permit, end-user document, customs approval, registration, transit authorisation or another government or regulatory document.

Unless expressly agreed otherwise in writing:

• Each party is responsible for approvals legally assigned to it.
• A quotation or payment request does not confirm that approval has been granted.
• Lead time may change while an approval is pending.
• Yubeen may require a satisfactory copy or confirmation before shipment.
• A rejected, expired, revoked or conditional approval may prevent or change the transaction.

Import, sale, possession, installation, use, demonstration or resale may be regulated in the destination country even where export from the country of origin is possible.

The importer or local customer should verify:

• Customs classification and declaration requirements.
• Import licences, product registrations or dealer authorisations.
• Taxes, duties, fees and customs-clearance responsibilities.
• Rules concerning optical, thermal-imaging, night-vision or related products.
• Local restrictions on mounting, possession, end use, resale, demonstration or transfer.

Website availability does not mean that a product is lawful or available for delivery in every country.

We may retain reasonable records relating to a transaction review, including correspondence, customer documents, declarations, screening results, approvals and shipping information.

Records may be retained for periods determined by:

• Applicable export, customs, sanctions, accounting or other legal requirements.
• Contractual obligations.
• The need to document a compliance decision.
• Limitation periods and dispute management.

Personal information within these records is also handled in accordance with our Privacy Policy.

To the extent permitted by applicable law and contract, Yubeen may request additional information, impose reasonable conditions, delay processing, suspend shipment or decline a transaction.

Reasons may include:

• Missing, inaccurate or inconsistent information.
• Unresolved destination, party, end-use or diversion concerns.
• A required licence or approval is absent.
• A bank, carrier, insurer or service provider cannot support the transaction.
• A change in law, sanctions, company policy or risk assessment.

A prior quotation, sample or transaction does not create an obligation to approve a later transaction.
